These terms and conditions outline the agreement between participants and The Camera Phone Workshop, regarding enrolment and participation in our photography workshops. By enrolling in a workshop offered by us, participants agree to comply with these Terms. Please read these Terms carefully before proceeding.

1. Website Terms of Use
These Terms of use (together with the documents referred to in it) informs you the terms of use on which you may make use of our website www.thecameraphoneworkshop (our site). Use of our site includes accessing, browsing, or purchasing on our site. By visiting our website, you are deemed to have accepted these terms and conditions contained herein. By using or visiting the website you expressly agree to be bound by these terms and agree to follow these terms and all applicable laws and regulations governing the website. You must comply with these terms of use irrespective of whether you have made a purchase. If you do not agree to these terms of use, you must not use our site.

2. Changes to these Terms
We reserve the right to amend these Terms at any time by amending this page. Please check this page from time to time to take notice of any changes we have made, as they are binding on you. Your continued use of our site shall be subject to such amended terms of use. We may update our site from time to time and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that our site, or any content on it, will be free from errors or omissions.

3. Ownership of the Rights and Intellectual Property Rights
For the purposes of these terms of use “Intellectual Property Rights” shall mean but not be limited to trademarks and service marks, trade names and business names, rights in goodwill, rights in designs, copyrights (including copyright in artistic, literary, dramatic, musical or other works and photographs), patents, rights in inventions, database rights, rights in know-how, confidential information and trade secrets and all other intellectual property rights (whether or not any of these is registered and including applications for registrations and rights to apply for registrations) and all rights and forms of protection of a similar nature or having equivalent effect to any of these which may subsist anywhere in the world. All Intellectual Property Rights in and to our site and the Workshop are owned by us and shall remain owned by us or our licensors. All rights, including Intellectual Property Rights in this website are owned by or licensed to The Camera Phone Workshop.

Any other use of the Workshop and any copying, reproduction, modification, distribution, sale, or any other use of any Workshop for any purpose shall be a breach of these terms of use. Without prejudice to any other rights or remedies that we may have in relation to such a breach, if you print off, copy, or download any part of the Materials in breach of these terms of use you must, at our option, return or destroy any copies of the Materials you have made.

On downloading the Materials from our site, you own the medium on which the Materials are recorded, but we do not transfer title to such Materials to you and we retain full and complete title to the Materials and all Intellectual Property Rights therein. You must not redistribute, sell, de-compile, reverse engineer, disassemble, or otherwise reduce any software contained in the Materials to human-readable form.
You acknowledge that all Intellectual Property Rights in and to the names “The Camera Phone Workshop” and any associated logos (the “Marks”) are and shall remain owned by us and that all goodwill accruing in the Marks shall accrue to and be owned by us.

4. Permitted Uses of website
As an individual you agree to use the information on the website as information purposes only.

Accessing Website:
Our website is available to visit free of charge. We do not guarantee that our website, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue, or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

5. Permitted use of Workshops:
We only supply the Workshops for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

If you are a Consumer
If you are a consumer, you may only purchase Workshops from our site if you are at least 18 years old. As a consumer, you have legal rights in relation to Workshops if they are not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.

If you are a business customer
If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use our site to purchase Workshops. These Terms and our Privacy Policy constitutes the entire agreement between you and us and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations, and understandings between us, whether written or oral, relating to its subject matter. You acknowledge that in entering into this Agreement you do not rely on any statement, representation, assurance, or warranty (whether made innocently or negligently) that is not set out in these Terms, or any document expressly referred to in them.

You and we agree that neither of us shall have any claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this Agreement.

6. Formation of Contract between you and us
Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

During the payment process you will be able to select which Workshops you wish to attend. The options will be made available to you and described during the payment process and the charges payable will be calculated based on the workshop that you choose.

You will be required to pay the applicable charges prior to being given access to the Workshops in accordance with your chosen workshop. If your payment is declined, not authorised or is otherwise unsuccessful we reserve the right to prevent your access to the Workshops.

If you have any promotional code entitling you to use any of the Workshops at a discounted rate, you must input that promotional code prior to making your payment. You will not be entitled to a refund of the Charges, or any part of them, if you subsequently notify us that you have any promotional code.

After you place an order, we will confirm our acceptance to you by sending you an e-mail (Purchase Confirmation). The contract between us will only be formed when we send you the Purchase Confirmation.

If we are unable to supply you with the Workshop, for example because the Workshop is no longer available or because of an error in the price on our site, we will inform you of this by e-mail and we will not process your order. If you have already paid for your order, we will refund you the full amount as soon as possible.

7. Enrolment and Registration:
To enrol in a workshop, participants must complete the purchase process and submit the required payment as specified by The Camera Phone Workshop
Workshop spots are limited and available on a first-come, first-served basis.
Participants must provide accurate and current information during registration. Any changes to contact information should be promptly communicated to us.

 

8. Price
The prices of the Workshops will be as quoted on our site from time to time. We take all reasonable care to ensure that the prices are correct at the time when the relevant information was entered onto the system. Prices for our Workshops may change from time to time, but changes will not affect any order which we have confirmed with a Purchase Confirmation. Our site contains many Workshops. It is always possible that, despite our reasonable efforts, some of the Workshops on our site may be incorrectly priced. If we discover an error in the price of the Workshops you have ordered, we will inform you of this error and we will give you the option of continuing with the order at the correct price or cancelling your order. We will not process your order until we have received your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Workshop to you at the incorrect (lower) price.

9. How to pay
We accept the following payment methods: Mastercard, Maestro, Visa, PayPal, Gpay, Stripe. We will charge your debit card, credit card or PayPal account immediately after sending you a Purchase Confirmation.

10. Delivery Policy
Once you purchase a Workshop from us, you will receive confirmation email straight away.

11. Changes to our terms in respect of the purchase and supply of our Workshops
We may revise our terms relating to the purchase and supply of our Workshops from time to time in the following circumstances: changes in how we accept payment from you; or changes in relevant laws and regulatory requirements. Whenever we revise our terms, we will keep you informed by email and state the date of the last variation at the top of this page.

12. Workshops
It is the responsibility of the customer to be compliant with any Workshop entry requirements. It is imperative that customers understand the requirement to prove the level of proficiency necessary to pass the Workshop. Should a customer not be deemed of sufficient standard to meet the necessary criteria, the Company accepts no liability for failure of the Workshop. The Camera Phone Workshop’s decision on customer’s grading is final.

13. Change, update, and amendments of the Workshop content
As part of our continuous Workshop development process, we reserve the right to make any change, addition, amendments, modification, or replacement of any part or whole of any Workshop contents whenever necessary.

14. Schedule
The Camera Phone Workshop will make reasonable efforts to adhere to the workshop content and schedule as advertised. However, the Company reserves the right to modify or cancel workshops, change instructors, or adjust schedules due to unforeseen circumstances.

The Camera Phone Workshop shall not be held liable for any losses or expenses incurred by participants due to changes in workshop content or schedule.

15. Participant Conduct:
Participants are expected to behave professionally and respectfully during workshops. Any disruptive or inappropriate behaviour may result in the participant’s removal from the workshop without refund.

Participants are responsible for their own safety and the safety of their equipment during the workshop. The Camera Phone Workshop is not liable for any injury, loss, or damage to participants or their property.

16. Photography Releases:
Participants may capture photographs during workshops for personal use. However, participants must respect the privacy and preferences of other participants and instructors when taking photos.

The Camera Phone Workshop reserves the right to use photographs, videos, or other media captured during workshops for promotional purposes, including marketing materials, social media, and our website.

17. Disclaimers
The Camera Phone Workshop does not promise that the website will be error free, uninterrupted, nor that it will provide specific results from use of the website. The results on the website are delivered at an “at the time available” basis.

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action based on the content on our site.

While we endeavour to update and ensure that the information contained in the Workshops and on our site is correct, we make no representations, warranties or guarantees, whether express or implied, as to the accuracy, completeness, currency, or reliability of any of them.

Some activities suggested or referred to in the Workshops may present a high risk of injury. You are always responsible for assessing the appropriateness of using the Workshop and must consider your personal health and physical suitability before using the same. You must consult a doctor if you are in doubt about your physical suitability.
We will not be held responsible for any injury, loss or damage resulting from use of the Workshops. We are also not responsible for providing advice on the health and safety requirements or precautions which should be observed when using the Workshop. You must ensure that you comply with the health and safety guidelines provided with the products or equipment that you are using.

18. Third Party
The Camera Phone Workshop does not endorse the content of any third-party website, nor do we warrant that they will not contain viruses or otherwise impact your computer. Where our site contains links to third party sites and to resources provided by third parties (together “Other Sites”), those Other Sites are merely linked to provide information only and are solely for your convenience. We have no control over and do not accept responsibility for Other Sites or for the content or products of Other Sites (including, without limitation, relating to social networking sites such as Facebook) and we accept no responsibility for any loss or damage that may arise from your use of them. If you decide to access any of the third-party sites linked to our site, you do so entirely at your own risk.

19. Liability and Limitation of Our Liability
Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law. To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms which may apply to our site or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, our site; or use of or reliance on any content displayed on our site.

If you are a business user, please note that, we will not be liable for: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill, or reputation; or any indirect or consequential loss or damage.

If you are a private consumer user, please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.

The photography workshop company is not liable for any personal injury, property damage, or loss of income that may occur because of participating in the workshop.

Participants must be in good physical and mental health to participate in the workshop.

Participants must have a good understanding of the English language to participate in the workshop, because all workshops are presented in English.

Participants must be aware of the risks associated with photography, including but not limited to:

Exposure to extreme weather conditions

Working with dangerous equipment

Being in remote locations

Participants agree to release the photography workshop company, its employees, and its agents from any liability for any injuries, losses, or damages that may occur because of participating in the workshop.

20. Viruses, Hacking, and other Offences
Due to the inherent risks of using the internet we cannot be liable for, and hereby exclude to the fullest extent permissible by applicable law, all liability for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site, Materials or to your downloading of any material posted on it, or on any website linked to it.

We do not warrant that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

During your use of our site, you must not knowingly or recklessly introduce any viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which they are stored or from which they are provided, or any server, computer or database connected to them. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site and Workshop will cease immediately.

21. Complaints handling
The Camera Phone Workshop will respond promptly if you inform us when we do not meet your expectations or keep our promise. You can inform us of your complaints by email or telephone.

22. Workshop Cancellations & Refunds
By completing and making a payment of full fees, you agree to the following Terms and Conditions:

Onsite Workshop (In house Workshop)
You have the right to cancel your booking at any time at the following terms:
You need to request the Workshop cancellation 7 working days before the Workshop starting date.

You are not eligible for any refund if you made a request for Workshop cancellation less than 7 working days before the Workshop starting date.

The Camera Phone Workshop reserves the right to cancel a Workshop if number of delegates have not reached the minimum required to run the Workshop effectively. The company also reserves the right to cancel in the event of an unforeseen circumstance which disables a safe training environment. In the event of a cancellation, The Camera Phone Workshop will either arrange for an alternative Workshop date or offer a full refund of the fee paid.

23. Online Workshops (Distance Learning)

Under this refund policy and under guidance of the Consumer Contracts Regulations 2013, you may cancel your purchase of the Workshop within the period of 14 calendar days (cancellation period) from the date on which the contract of purchase is concluded. Please note that, the right to cancel will not apply, after we issued your login detail for online study platform before receiving your cancellation request to us.

If you choose to cancel within this period, you will receive a refund of the price within 15 days if you are eligible for refunds. Once a Workshop has been redeemed, we cannot grant a refund. All refund requests can be sent to sally@thecameraphoneworkshop.com We will refund you on the credit card, debit card or PayPal account used by you to pay.

No refunds will be given for changes to the workshop itinerary or schedule.

No refunds will be given for the loss or damage of personal property.

No refunds will be given for travel expenses.

24. Privacy Policy
The Camera Phone Workshop maintains the strict privacy policy. We are committed to maintain your confidentiality as per our Privacy Policy. The Camera Phone Workshop collects and processes personal information in accordance with its Privacy Policy. By enrolling in a workshop, participants consent to the collection and use of their personal information as outlined in the Privacy Policy.

25. Amendments:
The Company reserves the right to update or modify these Terms at any time without prior notice. Participants are advised to review these Terms periodically for any changes.

By enrolling in a workshop offered by The Camera Phone Workshop, participants acknowledge that they have read, understood, and agree to these Terms and Conditions.
